Krishna Housing Scheme Project - Project Specific CIRP

The Hon'ble National Company Law Tribunal, New Delhi Bench, Court-IV vide order dated 21.06.2025 passed in CP (IB) No. 284/2025 in the matter of Shravan Minocha & Ors. vs. M/s Raheja Developers Limited, has admitted the application filed under Section 7 of the Insolvency and Bankruptcy Code, 2016 ("IBC") and initiated Corporate Insolvency Resolution Process ("CIRP") against M/s Raheja Developers Limited ("Corporate Debtor"). Thereafter the Hon'ble NCALT, video its order 10.04.2026 has restricted the CIRP to project specific for Krishna Housing Scheme Project only.

Therefore, now the CIRP pertains to the project namely "Raheja Krishna Housing Scheme", Sector-14, Sohna, Gurugram, Haryana.

Accordingly, a corrigendum to the public Announcement in the newspapers dated 11.04.2026, has been issued inviting claim from all claimants of the subject project and have received various claims as well from Allottees and continue to receive the same.

Project Overview (As on 21.08.2025)

Brief information about the Krishna Housing Scheme Project as on the 21.08.2025 as provided by the Corporate Debtor office is as follows; As per the records of the Corporate provide list of allottees of Residential and Commercial spaces (1572 + 41), via email dated 08.05.2025, claiming a total of 1413 Allotees in the Real Estate Project namely Krishna Housing Scheme. The above information is in the process of verification from the Corporate Debtor.

Submission Claims

Accordingly, pursuant to the provisions of the Insolvency and Bankruptcy Code, 2016 read with Regulation 6A and Regulation 16A of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, allottees/homebuyers being creditors in a class are requested to submit their claims, if not already submitted earlier.

The claims by Allottees are required to be submitted in Form CA along with supporting documents including:

  • 1.Builder Buyer Agreement / Allotment Letter/Agreement for sale
  • 2.Proof of payments made and Ledger provided by Corporate Debtor
  • 3.PAN Card and Aadhaar Card
  • 4.Address proof
  • 5.Any other supporting documents, evidencing existence of debt relating to the claim

It is further informed that creditors in a class shall be represented in the Committee of Creditors through an Authorized Representative Mr. Sanjay Mehra having IBBI Reg No. IBBI/IPA-001/IP-P01818/2019 -2020/12784 appointed in accordance with Section 21(6A) (b) of the IBC 2016 and Regulation 16A of the CIRP Regulations 2016.

Any homebuyer/allottee who has booked a flat or unit in the Krishna Housing Scheme project of Raheja Developers Ltd and has paid any amount (part or full) is eligible to file a claim.
Homebuyers are treated as Financial Creditors (in class) under the Insolvency and Bankruptcy Code, 2016.
Homebuyers or Allottees must submit their claim in Form CA – Claim by Financial Creditors in a Class (Allottees/Homebuyers).

Claims must be submitted only to the Resolution Professional (RP) and strictly in the manner specified in the Public Announcement dated 22.08.2025 followed by Corrigendum dated 11.04.2026.

Total amount paid under the project up to the insolvency commencement date i.e. 21.08.2025.

The Allottees should follow Regulation 16A(7) of the CIRP Regulations, 2016, which provides that the voting share of a creditor in a class shall be in proportion to the financial debt, including interest at the rate of eight percent per annum unless otherwise agreed between the parties.
The last date of submission as per corrigendum dated 11.04.2026 was 24.04.2026.

However, Allottees may submit their claims with proof up to the date of issue of request for resolution plans (RFRP) under Regulation 36B or ninety days from the insolvency commencement date, whichever is later.
The purpose of the insolvency proceedings is to make all efforts for revival of the stalled project by identifying a suitable developer through the CIRP process.

Allottees should not assume that submission of a claim automatically results in a refund.

Any refund or project completion terms will depend upon the Resolution Plan approved by the financial creditors and subsequently approved by the Hon’ble NCLT.
